Adult Guardianship in Oklahoma

Reviewed by DocDraft Legal Team - Oklahoma - Last updated October 9, 2026

In Oklahoma the district court appoints a guardian under the Oklahoma Guardianship and Conservatorship Act, 30 O.S. Sections 1-101 to 5-101, with adult proceedings in Article III. An "incapacitated person" receives a general guardian of the person and, as the court determines necessary and appropriate, a guardian of the property, while a "partially incapacitated person" receives a limited guardian (30 O.S. 3-112). The court must find incapacity by clear and convincing evidence (30 O.S. 3-111). Notice with a copy of the petition must be served personally on the person at least 10 days before a hearing that must be set no more than 30 days after the petition is filed. Oklahoma's "conservator" is a separate, narrow role for a physically disabled adult who consents.

How does a court decide an adult needs a guardian in Oklahoma?

Clear and convincing evidence must show (30 O.S. 3-111) incapacity: an adult whose ability to receive and evaluate information or make responsible decisions is so impaired they lack capacity to meet essential requirements for physical health or safety, or cannot manage financial resources. A partially incapacitated person is impaired only to the extent that, without a limited guardian, they cannot meet those requirements or manage all financial resources.

Which court and which form start an adult guardianship in Oklahoma?

The case is filed in the district court of the county. Under 30 O.S. 1-124, the Oklahoma Bar Association prepares the guardianship handbook, and its Handbook for Guardians of Adults was updated September 2024. Ask the court clerk which petition form the court requires, because the court's requirements control.

Does Oklahoma require a doctor's evaluation for an adult guardianship?

The court may, on its own motion or at a party's request, order an evaluation if it is in the ward's best interest and capacity is a material issue. A qualified expert performs it. A petitioner may attach an evaluation completed within 60 days before filing. A signed report must be submitted before the hearing that considers it.

What rights does the person have in an Oklahoma guardianship case?

Notice with the petition is served personally on the person at least 10 days before the hearing and cannot be waived, except a special guardian appointed on evidence of incapacity, serious harm from delay and an emergency care plan, with later service (30 O.S. 3-115). The person may request counsel, attend, present evidence, cross-examine and ask for a closed hearing.

Oklahoma's incapacitated and partially incapacitated tiers, 10-day personal service

Oklahoma uses its own vocabulary. The adult is the "ward" or the "subject of the proceeding," and the district court acts under the Oklahoma Guardianship and Conservatorship Act, with adult proceedings in Article III. An incapacitated person receives a general guardian of the person and, as the court determines necessary and appropriate, a guardian of the property (30 O.S. 3-112(A)). A partially incapacitated person receives a limited guardian of the person, the property, or both, and that finding is not a finding of legal incompetence (30 O.S. 1-111(22)). The court must find incapacity by clear and convincing evidence after a full hearing and examination, and must determine the extent of the incapacity and the feasibility of less restrictive alternatives (30 O.S. 3-111(B)). Evaluation is not automatic: the court may, on its own motion or at a party's request, order one if it is in the ward's best interest and capacity is a material issue, and a petitioner may attach an evaluation completed within 60 days before filing (30 O.S. 3-108, 3-101(C)). The hearing must be set no more than 30 days after the petition is filed, and notice with the petition attached must be served personally on the person at least 10 days before the hearing; notice to the person cannot be waived, except for special guardian appointments (30 O.S. 3-109, 3-110, 3-106(B), 3-115). Counsel is appointed upon request, and if the person is unrepresented the court inquires at the hearing under 30 O.S. 3-107. A "special guardian" is the emergency form and is effective until a guardian is appointed under Section 1-112 or for thirty (30) days, whichever is less. Oklahoma's "conservator" is a separate role open only to a physically disabled adult who consents (30 O.S. 3-211 to 3-220).

Regional Variances

Oklahoma adult guardianship requirements

Court

District court of the county, under the Oklahoma Guardianship and Conservatorship Act (30 O.S. 1-101 to 5-101).

Terms used

Guardian. An "incapacitated person" gets a general guardian of the person and, as the court determines necessary and appropriate, a guardian of the property; a "partially incapacitated person" gets a limited guardian; a "special guardian" is the emergency form. The adult is the ward or subject of the proceeding. A "conservator" exists only for a physically disabled adult who consents (30 O.S. 3-211 to 3-220).

Petition form

Title 30 provides statutory formats for the Notice of Hearing (3-110(D)) and the reports (4-305(B), 4-306(B)). Under 30 O.S. 1-124 the Oklahoma Bar Association prepares the guardianship handbook; its Handbook for Guardians of Adults was updated September 2024. Ask the court clerk, because the court's requirements control.

Incapacity standard and proof

An adult whose ability to receive and evaluate information effectively or to make and communicate responsible decisions is impaired to such an extent that the person lacks the capacity to meet essential requirements for physical health or safety, or is unable to manage financial resources (30 O.S. 1-111(12)). Proof: clear and convincing evidence (30 O.S. 3-111).

Medical or evaluator report

The court may, on its own motion or at a party's request, order an evaluation if it is in the ward's best interest and capacity is a material issue; a signed report is submitted before the hearing at which it is considered (30 O.S. 3-108). A petitioner may attach an evaluation completed within 60 days before filing (30 O.S. 3-101(C)).

Notice and service

Notice of the hearing with the petition attached, served personally on the person at least 10 days before the hearing, by the petitioner's attorney, sheriff or licensed process server with a return. Other listed persons get first-class mail notice at least 10 days before. Notice to the person cannot be waived; special guardian appointments are an exception (30 O.S. 3-106(B), 3-110, 3-115). The hearing is set no more than 30 days after filing (30 O.S. 3-109).

Right to counsel

Court-appointed counsel upon request (30 O.S. 3-106(A)(7)). If the person is unrepresented at the hearing, the court must appoint on request, may appoint if the person does not request but the court doubts capacity to decide and finds it in the person's best interest, and must not appoint if the person is capable of deciding and declines. Appointed counsel gets at least 5 days to prepare (30 O.S. 3-107).

Less restrictive alternatives

After finding incapacity, the court determines the extent of the incapacity and the feasibility of less restrictive alternatives, and an appointment order must include a specific finding by clear and convincing evidence that the identified needs require a guardianship instead of them (30 O.S. 3-111(B)). Limited guardianship is available for a partially incapacitated person (30 O.S. 3-112(B), 3-114).

Emergency guardian

A special guardian may be appointed when there is imminent danger of serious impairment of health or safety or serious damage to finances unless immediate action is taken, and no other person appears to have authority to act or the existing guardian is unable or refuses. Effective until a guardian is appointed under Section 1-112 or for thirty (30) days, whichever is less (30 O.S. 3-115).

Bond and reports

Guardian of the property: bond of not less than the value of the intangible personal property alleged or found, and the court may order no bond if anticipated annual income plus personal property is under $40,000; guardian of the person only: bond discretionary (30 O.S. 4-201). Sworn inventory within two months after appointment (4-301). Accounts at the expiration of a year and at least annually thereafter, except for a small estate (non-homestead assets under $40,000 if bonded, or under $10,000) with a spouse or relative within the fourth degree as guardian, unless the court directs otherwise (4-303(B)(3)); annual person report unless the court waives it (4-303).

Suggested Compliance Checklist

Weigh less restrictive alternatives

Before filing days after starting

Ask whether supported decision making, a representative payee, a durable power of attorney or healthcare power of attorney, would meet the need; a limited guardianship is a narrower form of guardianship, not an alternative to it. After finding incapacity, the court must determine the feasibility of less restrictive alternatives and may dismiss if they are feasible and adequate.

Decide on the evaluation

Before filing days after starting

The court may order an evaluation by a physician, psychologist, qualified social worker or other expert if it is in the ward's best interest and capacity is a material issue. A petitioner may attach an evaluation completed within 60 days before filing. Any signed report must be submitted before the hearing at which it is considered.

File the petition in the district court

At filing days after starting

File in the district court of the county. The Oklahoma Bar Association publishes a Handbook for Guardians of Adults (updated September 2024). Ask the court clerk which petition form the court requires and about fees, because the court's requirements control.

Serve notice and prepare for the hearing

At least 10 days before the hearing days after starting

Notice with a copy of the petition must be served personally on the person at least 10 days before the hearing, by the petitioner's attorney, sheriff or licensed process server with a return; other listed persons get first-class mail notice at least 10 days before. The hearing must be set no more than 30 days after filing. Counsel is appointed upon request.

Calendar bond, inventory and reports

After appointment days after starting

A guardian of the property gives a bond of not less than the value of the intangible personal property, unless the court orders none where anticipated annual income plus personal property is under $40,000; bond for a guardian of the person only is discretionary. The sworn inventory is due within two months after appointment, and accounts and reports are annual, except that the annual accounting does not apply to a small estate (non-homestead assets under $40,000 if bonded, or under $10,000) with a spouse or relative within the fourth degree as guardian unless the court directs otherwise.
