Stepparent Adoption in Montana
Reviewed by DocDraft Legal Team - Montana - Last updated October 6, 2026
In Montana a stepparent adopts in the district court (MCA 42-1-103(8)), and must obtain an order terminating the rights of the child's noncustodial parent prior to or contemporaneously with the petition to adopt (MCA 42-4-310). That parent can relinquish parental rights to you in writing (MCA 42-4-301), or the court can terminate those rights for unfitness under MCA 42-2-608, for example when the parent, if able, has not contributed to the child's support for an aggregate period of 1 year before the adoption petition is filed, after notice of the termination hearing is served on that parent. Your spouse must have legal and physical custody, the child must have lived with you both during the 60 days before filing (MCA 42-4-302), and your spouse files a written consent. A child 12 years of age or older must also consent (MCA 42-4-303(2)).

How are the other parent's rights ended in a Montana stepparent adoption?
MCA 42-4-310 requires an order ending the other parent's rights before or with your petition. The parent may sign a relinquishment (MCA 42-4-301). Otherwise, after notice of the hearing, the court may find unfitness under MCA 42-2-608, such as willful abandonment (MCA 41-3-102) or, if able, no support contribution for an aggregate 1 year before the adoption petition.
Which court and which form are used for a stepparent adoption in Montana?
File in the district court, through the Clerk of District Court in your county (MCA 42-1-103(8)). The Montana Judicial Branch posts a statewide Stepparent Adoption Packet with a petition, consents, a Waiver of Parental Rights and a decree. The packet is only for cases where the other parent agrees in writing or that parent's rights are already terminated.
Is a home study required for a stepparent adoption in Montana?
Not always. Under MCA 42-4-309, in a stepparent adoption, if the court is satisfied that the adoption is in the best interests of the child, it may waive the preplacement evaluation and the 6-month postplacement evaluation and report and grant a decree. The waiver is the court's decision, so ask for it in your petition.
At what age must the child consent to a stepparent adoption in Montana?
If the child has attained 12 years of age, the child shall consent to the adoption (MCA 42-4-303(2)). MCA 42-2-301(6) lets the child consent either in writing or in court, unless the child does not have the mental capacity to consent. The state packet includes a Child's Consent to Stepparent Adoption form for this.
Montana's termination-first rule, the district court, and the 60-day standing test
Montana handles stepparent adoption in Title 42, chapter 4, part 3 of its code, and adoptions are heard in the district court (MCA 42-1-103(8)). You have standing under MCA 42-4-302(1)(a) if your spouse has legal and physical custody of the child and the child has been in the physical custody of your spouse and you during the 60 days preceding the filing of the petition. Montana does not simply excuse the other parent's consent: MCA 42-4-310 requires an order of termination of the noncustodial parent's rights prior to or contemporaneously with the petition to adopt, and MCA 42-4-302(3) lets you join the two petitions. The other parent may relinquish rights to you in writing before a notary (MCA 42-4-301, 42-2-408). If not, the court may terminate for unfitness under MCA 42-2-608, including when the parent has willfully abandoned the child as defined in MCA 41-3-102; when it is proven to the satisfaction of the court that the parent, if able, has not contributed to the support of the child for an aggregate period of 1 year before the filing of a petition for adoption; or when it is proven to the satisfaction of the court that the parent is in violation of a court order to support the child or other children with the same birth mother. A ground written for stepparent cases, MCA 42-2-608(1)(h)(ii)(B), applies to a parent given proper notice of hearing who is a respondent to the petition to terminate, when the child is in the legal and physical custody of the other parent and the stepparent: the court must find upon clear and convincing evidence that the parent is not able or willing to promptly establish and maintain contact with the child and to pay for the child's support in accordance with the parent's financial means, and by a preponderance of the evidence that termination is in the child's best interests. The court may waive the home study under MCA 42-4-309, and a child 12 or older must consent (MCA 42-4-303(2)). The Montana Judicial Branch posts a statewide Stepparent Adoption Packet for consent cases.
Relevant Laws
MCA 42-4-302 to 42-4-304 (Standing and consent in stepparent adoption)
A stepparent has standing if the spouse has legal and physical custody and the child was in the physical custody of the spouse and the stepparent during the 60 days preceding the petition. The custodial parent files a written consent under MCA 42-4-304, and if the child has attained 12 years of age, the child shall consent.
MCA 42-4-310 and 42-2-608 (Termination of the other parent's rights)
MCA 42-4-310 requires an order of termination of the noncustodial parent's rights prior to or contemporaneously with the petition to adopt. MCA 42-2-608 lists unfitness grounds, including willful abandonment, failure, if able, to contribute to support for an aggregate period of 1 year before the adoption petition, and, for a child in the custody of the other parent and a stepparent, a parent not able or willing to promptly establish and maintain contact and pay support, found upon clear and convincing evidence, with best interests found by a preponderance.
MCA 42-4-309 (Evaluation waiver in stepparent adoption)
In a stepparent adoption, if the court is satisfied that the adoption is in the best interests of the child, the court may waive the requirement of a preplacement evaluation and the 6-month postplacement evaluation and report and grant a decree of adoption.

Unfitness grounds under MCA 42-2-608 include: willful abandonment as defined in MCA 41-3-102; proof to the satisfaction of the court that the parent, if able, has not contributed to the support of the child for an aggregate period of 1 year before the filing of a petition for adoption; proof to the satisfaction of the court that the parent is in violation of a court order to support the child or other children with the same birth mother; and, for a parent given proper notice when the child is in the legal and physical custody of the other parent and the stepparent, a finding upon clear and convincing evidence that the parent is not able or willing to promptly establish and maintain contact with the child and to pay for the child's support in accordance with the parent's financial means, plus a finding by a preponderance of the evidence that termination is in the child's best interests. A served parent who fails to appear can be found to have irrevocably waived rights (MCA 42-2-611).

The court may waive the preplacement evaluation and the 6-month postplacement evaluation and report if satisfied the adoption is in the child's best interests (MCA 42-4-309).
Residency or waiting period
The child must have been in the physical custody of the spouse and the stepparent during the 60 days preceding the petition (MCA 42-4-302(1)(a)). The decree requires 6 months of physical custody unless the court for good cause waives it under MCA 42-4-309 (MCA 42-5-106(1)(a)).
Child's consent age
12 years of age or older (MCA 42-4-303(2)), in writing or in court, unless the child does not have the mental capacity to consent (MCA 42-2-301(6)).
