Not paid afterward, not handed over only if asked: accompanied. One statement covers a trial or hearing subpoena under Rule 45(d) of the Arkansas Rules of Civil Procedure, the other covers a deposition subpoena under Rule 45(e). Arkansas then runs two different clocks. A witness summoned to a trial or hearing must be properly served at least two days before it, and the rule is deliberate that this applies regardless of his or her county of residence, so distance does not buy more notice. A witness summoned for a deposition must be served at least five business days ahead, and Rule 45(e) adds a place limit of its own: the witness must attend at any place within 100 miles of where he or she resides, is employed, or transacts business in person, or at another convenient place the court sets. Fee Must Accompany the Subpoena

Arkansas sets the attendance rate at $30.00 per day, and the Arkansas Judiciary's own form states the figure twice, once for a trial or hearing subpoena and once for a deposition subpoena.
Mileage at $0.25 a Mile
Travel is paid at $0.25 per mile from the witness's residence to the place of the trial, hearing or deposition (Ark. R. Civ. P. 45(d) and 45(e)). The rate is a flat statewide figure in the rule, not a county-set amount.
Two Days Before a Trial or Hearing
Regardless of the witness's county of residence, service must be made at least two days before the trial or hearing, or within a shorter time if the court so orders (Ark. R. Civ. P. 45(d)). Distance does not buy additional notice.
Five Business Days Before a Deposition
A deposition subpoena must be properly served at least five business days before the deposition, or within a shorter time if the court so orders (Ark. R. Civ. P. 45(e)). Business days, not calendar days, so weekends and holidays push the service date earlier.
Deposition Place Within 100 Miles
The witness is required to attend a deposition at any place within 100 miles of where he or she resides, is employed, or transacts business in person, or at another convenient place set by court order (Ark. R. Civ. P. 45(e)). This is Arkansas's own limit on the place of a deposition.
Ten-Day Written Objection
If a written objection to inspection or copying is made within ten days of service, or by the compliance time if that is sooner, the party who caused the subpoena to issue is not entitled to inspect the materials unless the court so orders (Ark. R. Civ. P. 45(e)). A motion to quash or shift production costs is also available under Rule 45(b).
Warrant and Contempt for Nonattendance
When a witness fails to attend in obedience to a subpoena, or intentionally evades service by concealment or otherwise, the court may issue a warrant for arresting and bringing the witness before the court to give testimony and answer for contempt (Ark. R. Civ. P. 45(g)). No fixed dollar forfeiture is set in the rule.
