Introduction

A Colorado owner who cannot reach the counter in person can move that job to somebody else on form DR 2175, whether it is signing for a title, a registration or a lien release, and the first unusual thing the form asks for is the day the arrangement stops. The termination date field is printed in bold and marked required, so a Colorado vehicle power of attorney cannot be left open ended the way most states allow. The Department of Revenue Division of Motor Vehicles gives the form the title Power of Attorney for Motor Vehicle Only and prints two statutes under it, C.R.S. 15-14-701 and C.R.S. 15-14-705, with the warning that any alteration or erasure may void the document. What the agent may do is a checklist rather than a sentence. Eight powers are printed with a blank beside each: apply for and receive a new or temporary registration, a certificate of title, or a duplicate certificate of title; transfer ownership and acknowledge the odometer reading; record a lien; release a lien; obtain a copy of a motor vehicle record; and receive a disability parking placard. The form invites you to check the ones you want and cross out the ones you are withholding. Notarization is required: the acknowledgment block at the foot reads subscribed and affirmed, or sworn to before me, and takes the notary's signature, printed name, commission expiry and seal. Colorado also has the grantor certify under penalty of perjury in the second degree, so both appear on the same page. One more Colorado rule to plan around. Where ownership is transferring, the original DR 2175 is surrendered, while certified copies are accepted for every other power. Key Things to Know

  1. 1

DR 2175 is titled Power of Attorney for Motor Vehicle Only, and it appoints an agent to act for the owner on whichever of eight printed powers are checked, pertaining only to the motor vehicle described on the form.

  2. 2

A termination date is mandatory. The form prints the words termination date required beside a blank date, so a Colorado vehicle power of attorney always has an end date on its face.

  3. 3

It must be notarized. The block at the foot reads subscribed and affirmed, or sworn to before me, and records the state and county of acknowledgment, the notary's signature and printed name, the commission expiry and a seal.

  4. 4

The grantor also signs a certification under penalty of perjury in the second degree that the information is true and accurate. Colorado prints both that certification and the notary block on the same page.

  5. 5

Where ownership is transferring, the original DR 2175 must be surrendered. Certified copies are acceptable for all the other powers, and the agent may keep a copy for record keeping.

  6. 6

The form cannot be used where one person or entity will sign as both buyer and seller on the odometer disclosure. That needs the DR 2174, Secure Power of Attorney, instead.

  7. 7

Any alteration or erasure may void the document, and the warning is printed at the top of the page, above the explanation of what the agent may do.

Colorado Requirements for Vehicle Power of Attorney

  • Form DR 2175, Power of Attorney for Motor Vehicle Only

Colorado uses form DR 2175, titled Power of Attorney for Motor Vehicle Only, issued by the Department of Revenue, Division of Motor Vehicles, Title and Registration Sections. The form line reads DR 2175 (08/21/12), and the statutes C.R.S. 15-14-701 and C.R.S. 15-14-705 print beneath the title.

  • Notarization Required

The block at the foot of DR 2175 reads subscribed and affirmed, or sworn to before me, records the state and county, and takes the notary's signature, printed name, commission expiry and seal. The grantor executes the form in the notary's presence.

  • Termination Date Is Required

DR 2175 prints the words termination date required beside a blank date, so the grantor has to name the day the authority ends. There is no option to leave it open until revoked, and an expired form is no use at the counter.

  • Eight Checkbox Powers, Withheld Ones Crossed Out

The powers are a new or temporary registration, a certificate of title, a duplicate certificate of title, transferring ownership and acknowledging the odometer reading, recording a lien, releasing a lien, a copy of a motor vehicle record, and a disability parking placard.

  • Certification Under Penalty of Perjury in the Second Degree

Besides the notary block, the grantor signs a certification under penalty of perjury in the second degree that the information on the form is true and accurate to the best of their knowledge. Colorado prints both on the same page.

  • Original Surrendered for a Transfer of Ownership

The original power of attorney must be surrendered to transfer ownership and acknowledge the odometer reading. Certified copies are acceptable for all other powers, and the agent may retain a copy for record keeping purposes.

  • DR 2174 Secure Power of Attorney for Both Sides

DR 2175 cannot be used to let one individual or entity sign as both buyer and seller disclosing and acknowledging the odometer reading. That requires the DR 2174, Secure Power of Attorney. The non-secured form is fine where the agent signs as buyer only or seller only.

  • Secure and Verifiable Identification, and the Agent's Duties

The form records the grantor's Colorado driver license, Colorado identification card or other identification with its number, expiry and date of birth, because secure and verifiable identification is required to obtain a title or registration in Colorado. The agent is warned that exercising the powers brings fiduciary responsibilities under Colorado law.
