Understanding employment law in New York

New York generally follows the employment-at-will doctrine, meaning employers and employees can often end an employment relationship without a specified reason.

However, federal and state laws prohibit certain forms of discrimination, retaliation, and other unlawful employment practices.

New York Labor Law Article 6 also sets requirements for paying wages, deductions, and pay notices. For example, an employer generally must notify a terminated employee in writing of the exact termination date and the date employee benefits end, no more than five working days after the termination.

Unpaid wage claims can be filed with the New York State Department of Labor's Division of Labor Standards, which generally does not accept claims for wages earned more than three years earlier. A court claim under the Labor Law generally must be brought within six years.

Different claims can involve different deadlines and legal standards.
