Understanding child custody and support in New York

New York courts use terms such as custody and visitation, often called parenting time, when addressing parental rights and time with a child.

Custody cases usually start with a petition in Family Court, generally in the county where the child lives. When parents are divorcing, custody may instead be decided by the Supreme Court as part of the divorce. Filing a custody petition in Family Court is free.

Courts generally consider the child's best interests when making custody decisions. Child support is generally calculated under the Child Support Standards Act, which applies a set percentage of combined parental income based on the number of children, along with other factors.

If you already have a court order, changing it generally requires asking the court for a modification based on a change in circumstances. A child support order can also be changed after three years, or after either parent's income changes by 15% or more, unless the parents opted out in writing. A private agreement alone does not change an existing order.
