Understanding child custody and support in California

California law separates legal custody, the right to make decisions about a child's health, education, and welfare, from physical custody, which is where the child lives. Either can be joint or sole, and a parent without physical custody usually has visitation, also called parenting time.

Custody and visitation may be decided as part of a divorce or legal separation, or in a separate case between parents. When parents disagree about custody or visitation, the court generally sends them to mediation with Family Court Services before deciding the contested issues.

Courts decide custody based on the child's best interest, with the child's health, safety, and welfare as primary concerns. Child support is calculated under California's statewide guideline, which generally considers both parents' incomes and how much time the child spends with each parent.

If you already have a court order, changing it generally requires asking the court for a modification. A private agreement alone does not change an existing order.

12. Security deposit. Landlord will refund the deposit, less deductions for damage beyond normal wear and tear1, or an itemized statement of deductions with any remaining balance, within 21 days after Tenant vacates.

1Question for an attorney

Does carpet wear from two years of normal living count as damage?

18. Default. If rent is late, Landlord may serve Tenant a written notice to pay rent or quit within three days2, not counting Saturdays, Sundays, or judicial holidays; if Tenant does not pay in full within that time, Landlord may file an unlawful detainer action.

2Question for an attorney

If I get the notice on a Thursday, which day is my last day to pay?
