Understanding child custody and support in Georgia

Georgia law speaks of legal custody, the right to make major decisions about a child's education, health care, religion, and extracurricular activities, and physical custody, where the child lives. Courts may award either kind to one parent or jointly to both.
Custody may be decided as part of a divorce or in a separate case between parents. In most cases involving custody, each parent or both parents together must submit a parenting plan to the court.
Courts decide custody according to the child's best interests. A child who is 14 or older may choose the parent they want to live with, and that choice is presumptive unless the judge finds it is not in the child's best interests. For a child aged 11 through 13, the judge considers the child's wishes but is not bound by them.
Child support is set under Georgia's guidelines, which generally consider both parents' incomes, along with individual circumstances. A father who was not married to the mother generally must legitimate the child before he can seek custody or parenting time.
If you already have a court order, changing it generally requires a modification through the court. A private agreement alone does not change an existing order.
