Understanding child custody and support in Ohio

Ohio law uses the terms allocation of parental rights and responsibilities rather than custody. A court may name one parent the residential parent and legal custodian, with parenting time for the other parent, or approve a shared parenting plan in which both parents share those rights and responsibilities.

These issues may be addressed as part of a divorce, a dissolution, or a separate case between parents. A parent who asks for shared parenting generally must file a proposed shared parenting plan at least 30 days before the hearing, or with the petition in a dissolution.

Courts allocate parental rights and responsibilities according to the child's best interest. Child support is calculated under Ohio's child support guidelines, which generally consider both parents' incomes, along with individual circumstances.

If you already have a court order, changing it generally requires a modification through the court. A private agreement alone does not change an existing order.

Residential leaseExample draft

12. Security deposit. Landlord will refund the deposit, less deductions for damage beyond normal wear and tear1, within 30 days after the lease ends and Tenant delivers possession, with an itemized written notice of any deductions sent to Tenant's forwarding address.

1Question for an attorney

Does carpet wear from two years of normal living count as damage?

18. Default. If rent is late, Landlord may serve Tenant a written notice to leave the premises at least three days2 before filing an eviction action in court.

2Question for an attorney

If I pay the rent in full during the three days, can the landlord still file?
