Understanding landlord-tenant law in Georgia

Georgia law establishes rights and responsibilities for both residential landlords and tenants. A 2024 law, often called the Safe at Home Act, added protections for leases entered into or renewed on or after July 1, 2024, including a requirement that rentals be fit for human habitation and a cap on security deposits of two months' rent.

An eviction in Georgia is called a dispossessory proceeding and is usually filed in magistrate court. For leases entered into or renewed on or after July 1, 2024, before filing for unpaid rent, a landlord generally must give the tenant a written notice to vacate or pay all that is owed within at least three business days, posted on the door in a sealed envelope and also sent in any way the lease provides. A tenant who is served with a dispossessory generally has seven days to answer.

In many situations, written communication and good documentation are important first steps.

A landlord generally must return the security deposit within 30 days after regaining possession of the rental, with a written statement of the reasons for any amount kept. A landlord may not keep any part of the deposit for normal wear and tear.

The appropriate action depends on the lease, the property, and the facts of the dispute.
